Introduction

Cannavista, LLC (“Cannavista”) is strongly committed to protecting the privacy of its members and visitors. This privacy policy (“Privacy Policy”) describes what information Cannavista may collect from its members and visitors and how we may use that information once it is collected. 

What Websites Does This Policy Apply To?

This Privacy Policy applies to the website located at cannavista.com (the "Website"). It does not apply to any other websites, including those that link to the Website or third-party websites to which Cannavista links. This Privacy Policy does not apply to the practices of any third party, affiliate or business partner that Cannavista does not own or control.

Privacy Policy Changes

Cannavista reserves the right to change this Privacy Policy at any time without prior notice. Any changes to this Privacy Policy will be posted on this page and will be effective immediately upon posting.

Collection of Non-Personal Data

If you browse the Website, you do so anonymously. We do not collect your e-mail address or other personal information. We do log your IP address (the internet address of your computer) to tell us which parts of our Website you visit and how long you spend there. We do not link your IP address to anything personally identifiable; however, we do track the state and/or country from which you are accessing the Internet, the date and time you visited and the type of computer, operating system and Web browser you are using. Your browser supplies us with this information. We use this information from our server logs to learn more about our visitors as a group, not about you as an individual. The information helps us identify overall usage patterns and trends on the site.

Collection and Use of Your Personal Information

Except as specified in this Privacy Policy, Cannavista will not sell or disclose your name, e-mail address or other personal information to third parties without your explicit consent.

Cannavista collects certain information about you in order to allow your account to function properly, to sell products and services, to enable you to make purchases and to complete transactions with third parties on the Website. At any time, you may log in and change this information, or remove it; provided, such actions may reduce or eliminate your ability to use all features of the Website.

Although we reserve the right to monitor the type of products you offer for sale on the Website, sales volumes, product description and sales content information and response data from time to time to make sure they comply with our Terms of Use, we will never share, sell or rent your membership information or e-mail address to anyone for any reason.

As part of the buying and selling process, Cannavista will share information between the two members involved in the transaction. You may obtain another Cannavista member's e-mail address, shipping address, payment information, and/or other information. You have a limited license to use this information only for Cannavista-related communications or for Cannavista-facilitated transactions. Cannavista has not granted you a license to use the information for unsolicited commercial messages. Without express consent from that person, you must not add any Cannavista member to your e-mail or physical mailing list.

Your username, Cannavista ID or alias is publicly displayed and connected to your Cannavista activity. Other people may see your date joined, feedback, ratings, profile information, items listed for sale, shop pages, sold item listings, comments and/or other date on the Website.

Some members or visitors may connect to or register a Cannavista account using an external third- party application, such as Facebook, or an app developed using the Cannavista API. Cannavista may receive some data from those connected third-party applications. Connecting your Cannavista account to third-party applications or services is optional. You may optionally choose to provide your full name and other personal information to be publicly displayed in connection to your account and activity.

If you have optionally connected your account to an external, third-party application, such as Facebook, or an app developed using the Cannavista API, you can remove permission for the app by changing your account settings.

Disclosure of Your Personal Information

Cannavista may release your personal information to a third-party to (a) comply with a subpoena or other similar legal procedure; (b) defend the rights of Cannavista or its affiliates or business partners; (c) protect the personal or financial safety of Cannavista employees, agents, affiliates, business partners, customers or Website users; (d) comply with the law, when we believe in good faith that such disclosure is necessary for such compliance; or (e) investigate or take action regarding illegal activities, suspected fraud, or violations of Cannavista’s Terms of Use. We may disclose personally identifiable information to parties in compliance with applicable internal policies, as we, in our sole discretion, believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. In such events, Cannavista may disclose your name, address, country, phone number, e-mail address and company name.

Third-Party Services

Cannavista employs other companies and people to perform tasks on our behalf, and we need to share your information with them to provide products and services to you. Examples include, but are not limited to, fulfilling orders, processing payments, handling billing disputes and collections, analyzing data, providing marketing assistance and providing customer service. Cannavista may partner with third-party services for fraud prevention and/or identity verification.

Cannavista is affiliated with a variety of businesses, some of which may offer promotions or sell items or services to you independently or jointly with Cannavista through the Website. We may share information (including aggregated demographic information) that is related to such transaction with that affiliated business.

The Website may offer features and services administered or provided by third parties hired by Cannavista. To receive these services, you may be required to provide these third parties with personal information. All such services are subject to separate terms and conditions established by our third-party providers, including separate privacy policies, which may be different than this Privacy Policy.

When you a load a page on Cannavista that has a social plug-in from a third-party site or service, such as a Like, Share or Send button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site.

SECURITY & SECURE BILLING TRANSACTIONS

You are asked to supply certain credit card and billing information in order to pay your Cannavista service charges. That information is transferred using secure transmission technology to a trusted third party for processing. The information is then encrypted and securely stored to handle your transactions.

Except for payment transactions, the Website does not use a secure server to transmit data to and from our site. Do not transmit any credit card or other financial or sensitive data through the Website unless you have first verified that the data is being submitted to our third-party service provider's secure server.

Messages From Cannavista

As a member, Cannavista may also send you messages related to certain features on the Website or your activity. Cannavista may also send you news or updates about changes to the Website or services. By default, members will receive these messages via e-mail, but you may choose to opt-out of getting certain e-mails under your account settings.

Cannavista may offer e-mail newsletters. You must opt-in or subscribe to begin receiving newsletters. Members may subscribe or unsubscribe from optional newsletters under your account settings or by following the instructions contained in the newsletter e-mails. Non-members may subscribe by providing an e-mail address, which will only be used by Cannavista for these newsletters. Non- members may unsubscribe from newsletters by following the instructions contained in the newsletter e-mails.

Community

Cannavista is both a marketplace and an online community, and Cannavista may facilitate public or semi-public forums, groups, live chat events and other features that allow members to connect and communicate on the Website. Your participation in such features is subject to our Terms of Use and this Privacy Policy.

Please use common sense and good judgment when posting in these community spaces or sharing your personal information with others on the Website. Be aware that any personal information you submit there can be read, collected or used by others, or could be used to send you unsolicited messages. Cannavista generally does not remove content from community spaces, and your posts may remain public after your account is closed. You are responsible for the personal information you choose to post in community spaces on Cannavista.

Data Retention

Cannavista will retain your information for as long as your account is active or as needed to provide you services. If you no longer want Cannavista to use your information to provide you services, you may close your account. Cannavista will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

California Residents' Rights to Personal Information

As a resident of California, you have the right to request from businesses a disclosure of data collection and sales practices in connection with your data. This includes: categories of personal information collected, the source of the information, use of the information and — if the information was disclosed or sold to third parties — the categories of personal information disclosed or sold to third parties and the categories of third parties to whom such information was disclosed or sold. As a California Resident, you are afforded:

  • The right to request a copy of the specific personal information collected about you during the 12 months before your request (together with a general “personal information request”)
  • The right to have such information deleted (with exceptions)

  • The right not to be discriminated against because you exercised any of these rights.

Removing or Updating Personal Information

You may change or correct your Cannavista account information (except your username) at any time. You may remove certain optional information you no longer wish to be publicly visible, such as your full name.

Governing Law and Jurisdiction

This Privacy Policy, and Cannavista’s collection and use of customer information, shall be governed and interpreted in accordance with the laws of the United States and the State of Nebraska. Any disputes arising out of this Privacy Policy shall be adjudicated in a court of competent jurisdiction in Omaha, NE.
